Punishments for DUI Offenses in Alabama
At Big John Alley Attorney at Law, we have experience in defending Auburn residents charged with driving under the influence, whether it is their first, second, or even third offense.
Many people get caught driving under the influence, whether it’s coming back from a party after consuming alcohol and/or illegal drugs, or taking prescription drugs for pain resulting in side effects that impair one’s ability to properly operate his or her vehicle properly.
Even the first offense can result in major penalties.
In the state of Alabama, just like any other state, if you are caught driving under the influence, you will be arrested automatically, even if you are a first time offender. You will also have your license suspended for a certain amount of time as well.
First Offense
If you are convicted of a DUI for the first time, the resulting penalties include the minimum fine of $600 ($750 in some city courts), or the maximum fine of up to $2,100. Your license will also be suspended for 90 days, and you can spend up to one year in jail.
Second Offense
If you are convicted for a second offense (within five years), the resulting fine will then range from $1,100 to $5,100, and this time your license will be revoked for one year. You can also be sentenced for up to another year in jail, and the minimum sentence for the second offense is serving five days in jail or having to perform 30 days of community service.
Third Offense
Becoming convicted of a third offense can have even more severe consequences. If you are convicted of a third offense, you are subjected to a fine between $2,100 and $10,100, and you will lose your driving privileges for three years. Although the maximum jail sentence is still one year, the minimum jail sentence for the third offense is now 60 days.
Even if you have been convicted on more than one offense, it is always imperative to consult with a lawyer who has the experience in dealing with cases involving DUIs. There may be crucial evidence which can work in your favor, such as whether or not your traffic stop was justified, if the breathalyzer device was accurate enough to prove you were driving under the influence, or any other factors involved in your case.
